You may use this website and our services subject to the following Terms of Use.
The owner of this website is LWLM Coaching Limited, trading as Live Well Live More (“LWLM”, “we”, “us” or “our”).
By using this website and/or our Services, you agree to accept these Terms of Use (“Terms”). If you do not agree with any part of these Terms, please stop using this website. We reserve the right to change these Terms at any time without notice to you.
Materials
1. The material found or offered on this website or provided by us to you (“Materials”) are for your own general information and non-commercial use only. The Materials are not intended to substitute for professional medical advice, diagnosis or treatment. The Materials are available for you to use at your own risk and you shall be responsible for ensuring the Materials are suitable for you.
2. We make no representation, warranty or guarantee about the accuracy, completeness, suitability or usefulness of the Material for any specific purpose. We will not be liable for your interpretation of, or for any inaccuracies or errors found in, the Material to the fullest extent excludable by law.
3. All Materials are either owned by or licensed to us. You may only use the Materials for your own personal use and not for any other purpose unless you obtain our written permission. The copyright notice at the bottom of this page forms part of these Terms.
Third party content
4. Any reference or link to third party content, websites, products or services are provided for further information purposes only and do not indicate or imply any endorsement, association, or other relationship between us and any third party. Should you access any link or choose to purchase or use any product, you do so at your own risk. We cannot be responsible for third party websites, products or services referenced on the website.
Services
5. Our services (“Services”) include (but are not limited to) fitness classes, yoga classes, workshops and coaching (individual and group) (each as described further on our website) and include classes designed to be available online, including live stream classes and on-demand classes as well as in person sessions.
6. In booking a Service you agree to comply with any additional rules we may make known to you in relation to the Service from time to time.
7. All Services are subject to change from time to time, even after you have booked. We will let you know about any changes as soon as we can, either via email or SMS.
8. Services are only booked when you have received a confirmation email from us and payment has been received in full (see below).
9. We operate a policy which prevents you from taking part in a group Service if you are more than 10 minutes late for the relevant group Service (in such situations you will be deemed to be “late”). This policy is in place to prevent injury and to be mindful of the teacher or coach and other participants in the Service. You will not be refunded for Services you are unable to attend because you are late.
10. In the event that we cancel a Service that you have booked, we will make reasonable efforts to contact you by email or telephone to let you know. If a Service is cancelled less than 2 hours (for online services) or 12 hours (for in person Services) before it is due to commence we will either offer to transfer you to an alternative session or refund you your fee.
Fees for Services
11. Prices for Services are as set out on the website or as otherwise agreed in writing between you and us. We reserve the right to adjust prices from time to time.
12. All Services must be paid for in advance unless otherwise agreed.
13. If you cancel a Service on less than 2 hours (for online Services) or 12 hours (for in person Services) notice you will not be entitled to a refund for that Service.
14. If you have purchased a monthly class pass it will be valid from the date of purchase to the date falling 30 days later. You will only be able to take classes while your class pass is active, otherwise you will need to purchase a class at the full pay-as-you-go price.
15. Where you have purchased Services on a pay-as-you-go basis or a monthly class pass then you may cancel your purchase within 14 days of the date of your purchase (“Cooling Off Period”) by contacting lwlmcoaching@gmail.com. If you cancel during the Cooling Off Period and have not booked any Services then you will be refunded the full charge for the relevant purchase. If you cancel during the Cooling Off Period and have booked 1 or more Services then you will be refunded the full charge for the relevant purchase less the cost of the Services booked (charged at full price).
Health and Safety
16. Some of our Services involve strenuous physical activity and we recommend that you seek medical advice before attending or participating in a Service where such activity is involved (including online). Your acceptance of these Terms constitutes your confirmation that you will comply with our reasonable instructions in relation to your participation in a Service.
17. You agree to ensure that your home workout space is suitable and safe for a Service, that you will wear appropriate footwear and clothing for a Service, following any guidance provided by LWLM and that you are solely responsible for this.
Waiver and Release
18. In consideration of being allowed to participate in the Services and to use the services provided by LWLM, in addition to the payment of any fee or charge, you waive, release and discharge LWLM from any and all responsibility and liability for any injuries or damages resulting (directly or indirectly) from your participation in and use of such activities and services.
19. You understand that physical exercise is a potentially hazardous activity which includes risk of injury and even death and that you are voluntarily participating in these activities and using the Services with the knowledge of and accepting the dangers involved.
20. You are aware that you have the right to request guidance on exercises from LWLM, in relation to the Services being undertaken and, but not exclusively, their suitability for you, with particular regard to your health. If you choose not to take advice, or to disregard any advice so given, you do so voluntarily and accept liability for all resulting injuries or damage. You agree that any directions given by LWLM are for guidance purposes only and that you will only act upon such directions where you am satisfied that it is safe and appropriate for you to do so having regard to your own health and surroundings.
21. By participating in a Service you declare yourself to be physically and mentally sound and suffering from no health condition or injury (other than those declared in your medical questionnaire) that would prevent your participation in such Service. You confirm that, where a medical condition has been disclosed to LWLM, you have your doctor’s permission to participate in the Services. You assume all responsibility for your participation in Services.
22. You will notify LWLM immediately during any Service if you feel unwell or am unable to participate. You will also notify LWLM of any changes to your health which may affect your continued use of the Services. You understand that LWLM activities are completely voluntary and you are not obliged to continue where you feel unable to, or do not wish to.
Confidentiality and Data Protection
23. We shall keep confidential any confidential information which you supply in connection with the Services.
24. You acknowledge and agree that we may for the purpose of providing the Services process personal data about you and consent to us processing such personal data for any purpose connected with the Services. We will adopt and maintain appropriate security measures for processing data.
25. We will use the personal information you provide to:
a. provide the Services;
b. process your payment for such services; and
c. if you agreed to join the Live Well Live More newsletter list, to inform you about the services Live Well Live More provides, but you may stop receiving these communications at any time by contacting Live Well Live More (livewelllivemore@gmail.com) and requesting to unsubscribe.
26. LWLM will only give your personal information to third parties where the law either requires or allows it.
General

28. Nothing in these Terms shall limit or exclude our liability to you for death or personal injury caused by our negligence or for fraudulent misrepresentation or any other liability that may not, under English law, be limited or excluded.
29. If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.
30. No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver, to be effective, must be in writing.
31. These Terms together with any policies we have in force from time to time constitute the entire agreement between us and you and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between us and you.
32. These Terms constitute a contract between you and us. No other person shall have the right to enforce any of these Terms.
33. These Terms shall be governed by the laws of England and Wales, and you agree that any dispute between us regarding them and/or the Services will be dealt with only by the courts of England and Wales.
